What Is UK Permanent Residence?

Indefinite Leave to Remain (ILR), also known as Permanent Residence or Settlement, is a restriction-free immigration status allowing the holder to live and work in the UK freely. ILR can lapse if you're outside the UK for more than two years consecutively - if that happens, it may be possible to apply to have your ILR re-instated (otherwise, fresh immigration permission will be required). 

How To Qualify For ILR

In order to make a successful ILR application, a number of requirements must be met. Some of the main considerations are outlined below. 

Residence in UK

Usually, you'll need to have lived in the UK for five continuous years on a qualifying visa type. The five year period must usually be spent with the same visa type, however it is sometimes possible to combine different visas. Another way of meeting the residence requirement is to live in the UK for 10 continuous years, for example on visa(s) which do not allow ILR after five years. For either route, you also must not have left the UK for more than 180 days in any rolling 12 month period during the qualifying residence period.

There are also some limited scenarios where you only have to remain for two years or three years, for example Investor Visas or Global Talent Visas.

Knowledge of English Language & UK Culture

Before seeking ILR status, you must usually meet an English language requirement, for example via an approved test, having a degree taught in English, or by holding citizenship from a majority English-speaking country recognised as such by the Home Office (e.g. the USA). It is also usually necessary to pass a Life in the UK Test. There are some limited exemptions from these requirements, for example applicants who are aged 65 and older. 

Income Thresholds

Some visa routes require an income threshold to be met in order to qualify for ILR - for example, Skilled Worker applicants must earn at least £25,600 or the going rate for the job (whichever is higher).

How To Apply For ILR?

Application forms are usually submitted online via the gov.uk website. Once the online form has been submitted, a biometric appointment must be booked and attended. All supporting documents are uploaded electronically - this can either be done online before the biometric appointment, or at the appointment itself for an additional fee. Supporting documents usually include a full scan of every page of all passport(s) held during the qualifying period; evidence that the Life in the UK Test has been passed and the English language requirement met; and a travel schedule covering the qualifying period. Different visa routes carry additional documentary requirements, for example Skilled Worker visa holders must also provide a letter from their employer plus their most recent payslip and bank statement. Once the biometric appointment is complete, the processing time begins. Timing can vary, but you should receive a response within six months. There are usually priority processing options available for an additional fee. Importantly, you must not travel outside of the UK while your application is pending - this will automatically withdraw the application.
